Welcome to Black Horizon Productions. These Terms & Conditions outline the general requirements, operational limitations, scheduling policies, and usage considerations associated with our aerial cinematography, commercial drone operations, inspection, mapping, spatial-data, and related production services.
By scheduling a consultation, requesting a quote, booking a project, or engaging Black Horizon Productions for services, you acknowledge and agree to the terms outlined below.
1. Airspace & Regulatory Compliance
All aerial operations performed by Black Horizon Productions are subject to applicable Federal Aviation Administration regulations, airspace restrictions, operating requirements, and required flight authorizations.
Certain project locations may require additional FAA approval or authorization before flight operations can legally take place.
Black Horizon Productions will not conduct any flight operation that cannot be completed safely and in accordance with applicable aviation requirements.
Project timing may therefore be adjusted when required by airspace restrictions, regulatory limitations, or FAA approval timelines.
2. Safety & Weather Conditions
Safety and legal compliance remain an absolute priority on every mission.
Aerial missions and project timelines are subject to change based on weather safety conditions and FAA airspace approvals.
Conditions that may affect scheduled operations can include unsafe wind, precipitation, visibility, severe weather, or other environmental or operational circumstances that could make a flight unsafe or non-compliant.
When weather conditions or FAA requirements prevent a scheduled mission from taking place, the project may be moved to an appropriate rescheduled date.
Black Horizon Productions reserves the right to postpone or discontinue aerial operations whenever conditions are considered unsafe or legally unsuitable for flight.
3. Scheduling & Project Availability
Project dates and consultation times are subject to availability.
Scheduling a consultation does not automatically guarantee that a flight mission can occur on a particular requested date. Final project timing may depend on weather, airspace conditions, FAA authorization, location requirements, project complexity, and operational availability.
Clients are encouraged to provide complete project details as early as possible so that operational requirements can be evaluated before the intended project date.
4. Retainer & Booking Confirmation
A mandatory $50 retainer deposit is required to confirm bookings.
A booking is not considered confirmed until the applicable retainer has been received.
If a scheduled mission must be postponed because of weather safety conditions or FAA-related delays, the retainer will transfer to the rescheduled project date.
5. Client-Initiated Cancellations
Client-initiated cancellations will result in forfeiture of the retainer deposit.
Retainers associated with weather-related or FAA-related rescheduling will transfer to the new approved project date rather than being forfeited.
Any additional project-specific cancellation, rescheduling, or payment requirements may be communicated in writing as part of the applicable project proposal or agreement.
6. Project Scope & Deliverables
The exact scope of work, deliverables, project schedule, production requirements, and pricing may vary depending on the service requested.
Services may include commercial and infrastructure inspections, aerial mapping and spatial-data capture, real estate media, cinematic production, events, campaigns, and other approved aerial operations.
Project-specific deliverables will be established through the applicable written quote, proposal, or project agreement.
7. Intellectual Property
Ownership, licensing, usage rights, delivery rights, and any restrictions relating to photographs, video footage, processed media, mapping outputs, spatial data, or other project assets will be governed by the written terms agreed upon for the individual project.
Where a project includes specific commercial usage or licensing requirements, those terms should be confirmed in writing before final delivery.
8. Operational Limitations
Black Horizon Productions cannot guarantee that every requested flight path, altitude, location, date, or operational concept can be approved or safely executed.
A requested operation may need to be modified, postponed, or declined when necessary to remain compliant with aviation requirements or maintain safe operating conditions.
Safety and regulatory compliance take priority over production schedules or creative requirements.
9. Project Changes
Changes to project scope, deliverables, locations, production requirements, or scheduling after a project has been confirmed may affect timing, availability, or pricing.
Any significant changes should be communicated as early as possible so that the revised mission requirements can be evaluated.

Final project requirements, pricing, deliverables, schedules, licensing terms, and operational conditions will be established through direct written communication and the applicable project agreement.
11. Acceptance of Terms
By requesting services, submitting a commercial quote request, scheduling a consultation, or confirming a project with Black Horizon Productions, you acknowledge that aerial operations may be affected by weather, safety considerations, airspace restrictions, and FAA approval requirements.
You also acknowledge the applicable retainer and cancellation policies described above.
